1. Introduction

Welcome to Shriharsh (“we”, “us”, “our”, or “the Company”). By accessing our website at shriharsh.com, or by engaging our services in any capacity, you (“Client”, “you”, or “your”) agree to be legally bound by the Terms and Conditions set forth in this document. Please read this agreement carefully before proceeding with any service engagement. If you do not agree to any part of these terms, you must not use our services.

These Terms and Conditions govern all website design, development, and related digital services provided by Shriharsh  to its clients across India and internationally.

3. Services Offered

Shriharsh provides the following web-related services:

  • Affordable Package (₹14,999): Single-page professional website with contact form, WhatsApp integration, mobile-friendly responsive design, basic SEO-ready structure, and delivery within 2–3 working days.
  • Standard Package (₹27,999): Multi-page business website with custom pages, 140+ XStore pre-built themes, SEO-friendly and Google-ready structure, and delivery within 5–7 working days.
  • Premium Package (₹49,999): Fully custom website design with advanced features, e-commerce setup, payment gateway integration, scalable architecture, premium support, and delivery within approximately 14 working days.
  • Additional services including website maintenance, content updates, SEO optimization, and third-party integrations may be offered at separately quoted rates.

4. Payment Terms

4.1 Advance Payment

The payment structure varies depending on the nature and scope of the project and the client relationship. In most standard engagements, a minimum advance of 25% of the total project value is required before work commences. In certain cases, particularly for smaller packages or new client relationships, 100% of the total payment may be required upfront. The applicable payment terms will be communicated to the client clearly at the time of project initiation.

4.2 Payment Methods

All payments are processed securely through Razorpay, our authorised payment gateway partner. We accept UPI, net banking, debit/credit cards, and other methods available through Razorpay. Payments must be made in Indian Rupees (INR) unless otherwise agreed in writing.

4.3 Hosting, Domain, and Third-Party Tools

Unless explicitly stated as part of a promotional offer, the cost of hosting, domain registration, premium themes, plugins, and any other third-party tools required to build or maintain the website is the sole responsibility of the client. Where we procure these tools on behalf of the client, additional charges equivalent to the actual cost — or a standard service fee — will apply and will be communicated before purchase. Occasionally, during special promotional campaigns, a free domain may be included. If this applies to your project, it will be clearly mentioned at the time of agreement.

The client is responsible for inquiring about any tool or hosting costs not explicitly mentioned. Shriharsh shall not be held liable for any misunderstanding arising from the client’s failure to ask about such costs.

5. Project Delivery & Timelines

Delivery timelines are estimates based on the package selected and are subject to the timely provision of all required materials by the client, including but not limited to: business details, logo files, images, written content, and feedback on design drafts. Delays caused by the client’s failure to provide necessary inputs will not be the responsibility of Shriharsh, and the delivery timeline will be adjusted accordingly.

  • Affordable Package: 2–3 working days
  • Standard Package: 5–7 working days
  • Premium Package: Approximately 14 working days

6. Revision Policy

Each package includes a defined number of complimentary revision rounds as outlined below. All revision requests must be submitted within 30 calendar days of the initial delivery. Revision requests received after this 30-day window will be treated as new work and quoted separately.

  • Affordable Package (₹14,999): 1 free revision round (minor changes only)
  • Standard Package (₹27,999): 2 free revision rounds (minor changes only)
  • Premium Package (₹49,999): 5 free revision rounds (minor changes) + 2 major structural changes

“Minor changes” refer to text edits, colour adjustments, image replacements, and similar small modifications. “Major changes” refer to layout restructuring, addition of new sections or pages, or significant functional changes. Any revisions beyond the included rounds will be billed at an agreed rate.

7. Post-Delivery Support

All packages include 30 days of complimentary support following the final delivery of the website. During this period, we will address technical issues directly related to our work at no additional charge.

Upon expiry of the 30-day support period, the full responsibility for the website, its content, performance, and maintenance rests solely with the client. Shriharsh is not liable for any issues, losses, or downtime that occur after this period unless the client has engaged us for ongoing maintenance under a separate agreement.

We do offer continued support and paid maintenance services beyond the free support window. For minor queries or small goodwill adjustments, we may assist the client at no cost, purely at our discretion, provided a professional and respectful working relationship is maintained.

8. Client Responsibilities

The client agrees to:

  • Provide all necessary content, images, branding materials, and business information in a timely manner.
  • Review design drafts and provide clear, consolidated feedback within a reasonable timeframe.
  • Ensure that all content and materials provided do not infringe upon any third-party intellectual property rights.
  • Make payments as per the agreed payment schedule.
  • Actively ask about any aspect of the project — including costs, timelines, or tools — that is not explicitly covered in the initial agreement.
  • Not hold Shriharsh responsible for delays, errors, or gaps caused by the client’s failure to fulfil the above responsibilities.

9. Intellectual Property & Ownership

Upon receipt of full and final payment, all design files and the completed website shall be transferred to the client. Until full payment is received, Shriharsh retains all rights to the work produced.

Shriharsh reserves the right to display the completed website in its portfolio, case studies, and promotional materials unless the client explicitly requests otherwise in writing prior to project completion.

10. Project Cancellation

If the client chooses to cancel the project after work has commenced, the advance payment is non-refundable under any circumstances. This covers the time, resources, and effort already invested by our team. No partial work-in-progress will be delivered upon cancellation unless explicitly agreed otherwise.

11. Limitation of Liability

Shriharsh shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the delivered website, including but not limited to loss of business, revenue, data, or reputation. Our maximum liability in any dispute shall not exceed the total amount paid by the client for the specific project in question.

We are not responsible for any third-party service failures, including hosting downtime, domain expiry, payment gateway issues, or plugin/theme malfunctions after delivery.

12. Confidentiality

Both parties agree to keep confidential any proprietary, sensitive, or business-critical information shared during the course of the project. Shriharsh will not disclose client data, business strategies, or project details to any third party without prior written consent, except as required by law.

13. Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or any service engagement shall first be attempted to be resolved through mutual discussion. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh, India.

14. Amendments to These Terms

Shriharsh reserves the right to update or modify these Terms and Conditions at any time without prior notice. The revised terms will be posted on our website with an updated effective date. Continued use of our services after any such changes constitutes acceptance of the new terms.
